These Terms govern use of the Iron Pulse Technology website. They do not replace a signed Master Services Agreement, Statement of Work, proposal, service agreement, order, or other negotiated client contract.
1. Acceptance and Website Use
Use this website lawfully and do not interfere with security, availability, or other users. Public website information is general.
2. Inquiries and Service Availability
Submitting a consultation or assessment does not create a service agreement, guarantee acceptance, establish an SLA, or obligate Iron Pulse Technology to provide services. Scope, deliverables, pricing, schedules, and support commitments are governed by applicable written agreements.
3. Client Responsibilities and Credentials
Clients are responsible for accurate information, authorized access, appropriate cooperation, and safeguarding credentials. Passwords, API keys, private keys, and authentication secrets should not be submitted through public forms.
4. Third-Party Services
Microsoft 365, Proxmox, cloud platforms, internet providers, carriers, software, and hardware may be subject to third-party licensing, availability, security, pricing, warranties, and terms.
5. Security, Backup, and Recovery Limitations
Technology and cybersecurity controls reduce risk but cannot eliminate every threat, outage, loss, compromise, or unauthorized access event. Backup and recovery commitments are governed by the contracted solution and applicable written agreement.
6. VoIP and Connectivity
VoIP may depend on internet connectivity, power, carriers, network configuration, equipment, and provider availability. Applicable emergency-calling requirements depend on the selected service.
7. Payment, Warranties, and Liability
Payment and refund terms are governed by applicable proposals, orders, invoices, or agreements. Public website information does not create warranties or guarantees. Contracted-service liability and indemnification are governed by applicable signed agreements, subject to rights that cannot legally be excluded.
8. Intellectual Property
Iron Pulse Technology branding and original website materials are protected by applicable law. Third-party trademarks and software remain property of their owners.
9. Suspension, Termination, and Force Majeure
Service suspension, termination, transition, data return, and force-majeure obligations are governed by applicable written agreements.
10. Colorado Law, Severability, and Changes
For website use not governed by a separate agreement, these Terms are intended to be governed by Colorado law. If a provision is unenforceable, remaining provisions continue to the extent permitted by law. These Terms may be updated as services or legal requirements change.
